What Happens If You Miss the SARS Tax Deadline?

Alarm clock above paperwork and wooden letters spelling deadline

Update checked 26 October 2026: the 23 October 2026 filing deadline for non-provisional individual taxpayers required to submit a return has now passed. If you still need to file, act promptly. First confirm your filing obligation: a correct SARS auto-assessment that you agree with does not require further action. Provisional taxpayers generally have until 22 January 2027.

The Penalty Structure

SARS can impose fixed monthly administrative penalties for outstanding returns. Amounts range from R250 to R16,000 a month according to taxable income and the applicable rules. Continued non-compliance can lead to further penalties, so submitting outstanding returns promptly is important.

How Interest Accrues

Unpaid tax debt can also attract interest. Filing and payment are separate obligations: submitting a return does not settle the tax, penalties or interest already owed. Check your assessment, statement of account and the payment dates and rules that apply to your circumstances. Do not assume the return-filing deadline is also the date from which every interest charge starts.

Requesting Remission

If you disagree with an administrative penalty, a Request for Remission (RFR1) may be appropriate. Explain the reason for the non-compliance and provide supporting evidence. SARS considers requests under the applicable requirements; relief is not automatic or guaranteed. Ordinarily, outstanding returns should first be submitted. Check SARS guidance for exceptions, including cases where you were not liable to file or SARS made an error.

Why Filing Late Is Still Better Than Not Filing

Addressing an outstanding return helps stop further penalties for that non-compliance and gives you a clearer picture of your tax position. It does not erase existing debt, resolve other outstanding obligations or guarantee that SARS will not request supporting documents.

Gather your IRP5 certificates, medical scheme information, retirement contribution certificates and any other records relevant to the return. Submit an accurate return, review the assessment and respond to SARS correspondence. Pay amounts due or, if you cannot pay in full, enquire about an appropriate payment arrangement rather than ignoring the debt.
